Website terms of use.

The terms on which you may use this website. They govern this website - nothing else.

These terms of use are not the merchant agreement. If you collect payments through Click2Pay, that relationship is governed by a separate written agreement signed by you. These terms do not vary, supplement or replace that agreement, and in the event of any conflict the signed agreement prevails. Merchants can ask for a copy of their signed agreement, and prospective merchants for our current merchant agreement, at enquiries@click2pay.co.za or via our contact page.

Your attention is drawn to section 9 (Liability and indemnity). It limits or excludes our liability to you, and it makes you responsible for loss you cause us by using this website unlawfully or by deliberately misusing it.

1. Who we are

This website is published by the two companies behind the Click2Pay product:

Both are registered Third-Party Payment Providers sponsored by Absa Bank Limited. In these terms, “we”, “us” and “our” mean both of those companies, jointly, and “you” means anyone who visits or uses this website.

2. What these terms cover

These terms apply to www.click2pay.co.za and to the enquiry form on it. They do not apply to the merchant portal at www.c2p-hub.co.za (opens in a new tab), which is governed by your merchant agreement, and they do not apply to any website we link to.

By using this website you agree to these terms. If you do not agree with them, please stop using the site.

3. What this website is for

This website describes what we do. It is information, not an offer: nothing on it is a quotation, a commitment to provide a service, an approval of any application, or financial, legal, tax or accounting advice. Whether we can act for you depends on the identity checks we carry out before taking on a merchant, and on a signed agreement.

Descriptions of the collection rails - DebiCheck, EFT debit orders, registered mandates and card - are general explanations of how the South African payment system works. They are not a promise about how any particular collection of yours will behave.

4. Accuracy, and keeping the site up

This website and everything on it is provided "as is" and "as available", without warranty of any kind, express or implied, to the fullest extent the law allows.

We take reasonable care to keep this site accurate and current, but the payment system changes and pages can fall behind it. We do not warrant that the content is complete, accurate or up to date, and you should not rely on it as your only source before making a decision. Where a page states a rule, a window or a fee set by someone else - a bank, the clearing house or a card scheme - that party's own current terms govern, not our summary.

We do not promise the site will always be available, or that it will be free of errors, interruptions or harmful code. We may change, suspend or withdraw any part of it, at any time, without notice.

5. Intellectual property

The content of this site - text, layout, graphics, illustrations, logos, icons and code - belongs to us or to our licensors and is protected by South African and international law.

You may view it, and print or download extracts, for your own non-commercial use, provided you do not alter anything and you keep any copyright or trade mark notices intact. Anything else - copying, republishing, framing, systematic extraction, or use in a commercial product - needs our prior written permission. “Click2Pay” and our logo are our trade marks and may not be used without permission. Other organisations' names and logos on this site belong to their owners, are used only to identify them, and imply no licence, membership or endorsement.

6. Using the site properly

You may not:

  • Use the site for any unlawful purpose, or in a way that breaches these terms
  • Introduce malware, or anything else designed to harm the site or its users
  • Attempt to gain unauthorised access to the site, its servers, or any connected system
  • Scrape, harvest or systematically extract content or contact details, including for marketing
  • Frame this website inside another site, or deep-link to a page in a way that misrepresents its source
  • Send unsolicited commercial messages to any address obtained from the site
  • Interfere with the site's operation, or place an unreasonable load on it
  • Submit anything false, misleading, defamatory, or belonging to someone else

We may restrict or block access where we reasonably believe any of these is happening. Deliberately introducing malicious code, or gaining or attempting to gain unauthorised access to this website or the systems behind it, is a criminal offence under the Cybercrimes Act 19 of 2020 - we will report it to the police, and may also pursue a civil claim for any resulting loss.

7. What you send us

Please do not send confidential information through this website. The enquiry form is for arranging a conversation, not for sensitive material - do not send bank account details, identity documents, card numbers or your customers' personal information through it.

How we handle the details you do give us is set out in our privacy policy. You confirm that any information you submit is accurate, and that where it concerns someone else you are entitled to give it to us.

If you send us feedback, a suggestion or an idea about our website or services, you agree we may use it freely, without payment or attribution to you, and without any obligation of confidence.

We may review the content of messages sent to us through this website's enquiry form, to maintain quality and to investigate or prevent fraud, abuse or unauthorised use of our systems. Please do not use this form to send us anything you would not want reviewed on that basis.

8. Links to other websites

Where we link to another website - a bank, a regulator or a partner - we do so for convenience. We do not control those sites, we are not responsible for their content or their handling of your information, and a link is not an endorsement. Their terms and privacy policies apply once you leave.

9. Liability and indemnity

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, for our own gross negligence or wilful misconduct, or under the Consumer Protection Act 68 of 2008 where it applies to you.

Subject to that, we are not liable for any direct, indirect or consequential loss, or for loss of profit, revenue, business, goodwill, data or anticipated savings, arising from your use of this website or your inability to use it - including loss caused by anything you relied on here. You use the internet at your own risk, and we are not liable for loss caused by a virus or other harmful material that reaches you through this site. If we are nonetheless liable to you, our total liability is limited to the amount, if any, you paid us to use this website.

If you use this website unlawfully or deliberately misuse it - for example by attacking it, scraping it, or using it to infringe someone else's rights - you are responsible for the loss that causes us, including a claim a third party brings against us as a result. This applies to deliberate or unlawful conduct only. It does not apply to ordinary use of the site, it does not apply to anything caused by our own gross negligence, wilful misconduct or fraud, and it does not apply where the law does not allow us to pass a loss on to you.

10. Electronic communications

If you give us your email address, we will normally reply to it. Under the Electronic Communications and Transactions Act 25 of 2002 a message sent electronically can satisfy a legal requirement that something be in writing, so we may give you notices by email.

Visiting this website does not subscribe you to any mailing list or service, and we do not treat a notice posted on this page as personal notice to you.

11. General

If we do not enforce any part of these terms on one occasion, that is not a waiver of our right to enforce it later.

We may transfer or assign our rights and obligations under these terms, including to a purchaser or successor of our business. You may not transfer yours without our written consent.

Nothing on this website, and nothing in these terms, creates a partnership, agency, joint venture or employment relationship between you and us. Neither of us may act, or represent that we may act, on the other's behalf.

No part of these terms is intended to give any benefit or right to anyone who is not you or us, and no one else may enforce them.

These terms are the whole agreement between us about your use of this website. Our privacy policy and PAIA manual explain how we handle information; they are notices, not part of this agreement.

12. Changes to these terms

We may change these terms. The version and date at the foot of this page tell you which version you are reading. Changes apply from the moment they are posted, so please check when you return.

13. Governing law

These terms are governed by the law of the Republic of South Africa, and any dispute about this website or these terms is subject to the jurisdiction of the South African courts. You and we consent to the jurisdiction of the Magistrates' Court for any claim within its jurisdiction, even where the High Court also has jurisdiction. Nothing in these terms takes away a right, a protection or a forum that a statute gives you.

If any part of these terms is found to be unenforceable, the rest continues to apply, and a court should read the affected part as narrowly as needed to make it enforceable while keeping as much of its original intent as possible.
